The Constitution, Homelessness, and the Supreme Court: Grants Pass v. Johnson

Hear how Gibson Dunn partners Theane Evangelis and Brad Hamburger obtained a landmark ruling in the U.S. Supreme Court making clear that the Eighth Amendment’s prohibition on “cruel and unusual punishment” does not prohibit enforcement of laws regulating camping on public property.  This decision overturned Ninth Circuit precedent that had led to a wave of litigation against local governments in California and injunctions that precluded the enforcement of basic public safety laws.  Theane and Brad will discuss their strategy for obtaining review from the Supreme Court and then a victory on the merits for the City of Grants Pass, as well as the consequences of the decision for local governments grappling with the homelessness crisis.
