A New Era in Jury Selection in California: Preparing for and Complying with AB3070

In 2020, the California Legislature passed AB3070, which seeks to address unfair exclusion in jury selection. AB3070 will take effect in criminal trials beginning January 1, 2022 and in civil trials beginning January 1, 2026.
AB3070 provides detailed guidance regarding permissible and impermissible preemptory challenges, and its primary change to the Batson procedure is that it acknowledges implicit and unconscious bias as improper bases for exclusion. AB3070 also allows a party or the trial court the opportunity to challenge opposing counsel’s use of peremptory challenges.
But how will AB3070 work in reality?
This program will address practical issues surrounding AB3070, from the perspective of lead trial lawyers, the bench, and the jury consultant. The panel will discuss the types of disputes that can be expected as AB3070 is implemented, whether the new laws will be effective in addressing bias in jury selection, and whether this law will lead to changes in other jurisdictions.
