Implicit Bias and Post-Judgment Review

Implicit bias ideas are familiar to most lawyers both as general principles and as the foundation for some jury selection rules and some jury instructions. More recently those ideas have been used to challenge verdicts in both criminal and civil cases. The success of such challenges in Washington suggests they may become more common.
This presentation examines challenges lawyers and judges face in using the general principles of implicit bias research to evaluate juror and trial conduct and to assess challenges to verdicts in specific cases.
